Terms of Service

The following Terms of Service ("Terms") are a legal agreement between you, either an individual or a single entity ("You" or "User"), and AldoSwag, its affiliates, and all of their respective officers, directors, employees, agents, and suppliers (collectively "AldoSwag") that governs your use of AldoSwag's e-commerce platform and Services (collectively, the "Services").
By accessing or using the Services, you are agreeing to these Terms and concluding a legally binding contract with AldoSwag. Do not access or use the Services if you are unwilling or unable to be bound by the Terms.
1. GENERAL TERMS
1.1 We reserve the right to make changes to these Terms at any time. Continued use of the Services signifies your acceptance of the changes.
1.2 The Service is intended for users who are at least 13 years of age. If you are under the age of 13, you are not permitted to register for the Service or send personal information to us.
2. REGISTRATION AND ACCOUNT SECURITY
2.1 You may be required to register for an account to access some or all of the Services. You are responsible for maintaining the confidentiality of your password and for all of your activities that occur under your account.
2.2 You represent and warrant that the information you provide to AldoSwag upon registration and at all other times will be true, accurate, current, and complete.
3. PRODUCT INFORMATION AND AVAILABILITY
3.1 AldoSwag attempts to be as accurate as possible in describing products. However, we do not warrant that product descriptions, prices, and website content are free from errors.
3.2 Products displayed may be out-of-stock or discontinued, and prices are subject to change. AldoSwag is not responsible for typographical errors regarding price or any other matter.
4. PRODUCTION AND SHIPPING TIMES
4.1 Orders will generally be shipped within 6-12 business days once the order is placed. However, in peak seasons, shipment can take longer.
4.2 AldoSwag is not responsible for delays in shipping caused by external factors (such as weather conditions, shipping courier delays, international customs issues, or any other factors beyond our control).
5. RETURNS, EXCHANGES, AND REFUNDS
5.1 All sales made through AldoSwag are final. We do not offer returns or exchanges on items after purchase, except in the specific circumstances outlined below.
5.2 In the event that a defective product is delivered, or a product delivered is not the size ordered, we will either process a refund or send the correctly ordered product to the customer at our discretion. In such cases, please contact us at aldoswaghelp@gmail.com within 14 days of receipt to initiate the refund or exchange process.
5.3 In order to facilitate the refund or exchange process in cases of defective or incorrectly sized items, customers are required to provide proof of the issue, such as photographs or other appropriate evidence, at the time of initiating the process.
5.4 The cost of return shipping for defective or incorrectly sized items will be borne by AldoSwag. In all other cases, shipping costs are non-refundable.
6. USER CONTENT
6.1 You are solely responsible for any content, including images, text, audio, or other material, that you post or transmit through the Service ("User Content").
6.2 You grant AldoSwag a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, store, display, reproduce, modify, create derivative works, perform, and distribute your User Content on AldoSwag for the purposes of operating, developing, providing, and using the AldoSwag Services.
7. PROHIBITED CONDUCT
7.1 You agree not to use the Service for any unlawful purpose or in any way that might harm, damage, or disparage AldoSwag or any third party.
8. INDEMNITY
8.1 You agree to indemnify and hold harmless AldoSwag and its officers, directors, employees, and agents, from and against any claims, suits, proceedings, disputes, demands, liabilities, damages, losses, costs and expenses, including, without limitation, reasonable legal and accounting fees (including costs of defense of claims, suits, or proceedings brought by third parties), in any way related to (i) your access to or use of the Services, (ii) your User Content, or (iii) your breach of any of these Terms.
9. DISCLAIMERS AND LIMITATION OF LIABILITY
9.1 The Service is provided on an "as is" and "as available" basis. AldoSwag expressly disclaims any warranties and conditions of any kind, whether express or implied, including but not limited to, the warranties of merchantability, fitness for a particular purpose, and non-infringement.
9.2 In no event shall AldoSwag, its directors, employees, or agents, be liable for any direct, special, indirect or consequential damages, or any other damages of any kind, including but not limited to, loss of use, loss of profits, or loss of data, whether in an action in contract, tort (including but not limited to negligence), or otherwise, arising out of or in any way connected with the use of or inability to use the Services, including without limitation any damages caused by or resulting from reliance by user on any information obtained from AldoSwag, or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission or any failure of performance.
10. GOVERNING LAW AND JURISDICTION
10.1 These Terms shall be governed by the laws of Canada, and in particular, the Province of British Columbia, without respect to its conflict of laws principles.
10.2 We each agree to submit to the personal jurisdiction of a Provincial Court located in British Columbia, Canada, for any actions not subject to Section 10.3 (Arbitration).
11. ARBITRATION
11.1 For any dispute you have with AldoSwag, you agree to first contact us and attempt to resolve the dispute with us informally.
12. COMPLETE AGREEMENT
These Terms and Conditions constitute the entire agreement between you and AldoSwag with respect to the Services and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and AldoSwag with respect to the Services.
